CUSTOMIZED PRODUCT SHIPPING TERMS AND CONDITIONS

1. Customized Product Orders

    1.1 Definition of Customized Products

    Customized products refer to orders where the customer requests modifications, including but not limited to:

    • Changes in the design of carved furniture.
    • Alterations in furniture measurements or sizes.
    • Modifications in polish, paint, or fabric design.
    • Any additional alterations or modifications that require extra work beyond the original design.
    • Additions that require additional work for the inclusion of new elements to the product.

    1.2 Approval and Timeline for Customized Orders

    The standard delivery timeline for customized products will commence only after the customer finalizes and provides written approval for all customization requests. Any initial delivery timeline provided for standard or pre-made products will be superseded by a new timeline starting from the date of final approval of all customizations. Healsway's standard shipping and delivery timelines will apply from this date.

    1.3 Non-Cancellation and Refund Policy

    Once the manufacturing process of a customized product begins, the order cannot be canceled, and no refunds will be issued for the cancellation of such products. However, Healsway may consider product exchanges at its discretion, subject to mutual agreement between the customer and Healsway.

    1.4 Sale of Canceled Customized Products

    In the event that a customer cancels a customized product order after manufacturing has started, they may authorize Healsway to advertise and sell the product. If sold, the amount received from the sale, which must be equal to or greater than the amount paid by the customer, will be credited to the customer's account, after deducting handling and bank charges.

     

    2. Cross-Border Shipping and Customs Regulations

      2.1 Customs Clearance Delays

      Healsway Systems Solution Pvt. Ltd. is not responsible for delays caused by customs clearance procedures in India or any other destination country, including the United States. These procedures are outside Healsway's control, and any delays arising from such processes will not affect the delivery timeline provided by Healsway.

      2.2 Cross-Border Shipping Terms

      All products are manufactured in India and shipped internationally. The shipping timeframes provided are estimates based on typical processing times. However, due to potential delays in customs clearance or other cross-border regulatory checks, Healsway cannot guarantee exact delivery dates. Customers will be kept informed of any such delays.

       

      3. Shipping Delays Due to External Factors

        3.1 Force Majeure Clause

        Healsway Systems Solution Pvt. Ltd. shall not be held liable for shipping delays caused by circumstances beyond its control, including but not limited to:

        • Natural disasters (e.g., earthquakes, floods).
        • Acts of war, terrorism, or political instability.
        • Maritime disruptions or port closures.
        • Labor strikes, port congestion, or other disruptions in shipping channels.

        3.2 Exclusion from Delivery Timeline

        Delays resulting from any force majeure events will not be counted within Healsway's delivery timeline. Customers will be promptly informed of such delays, and Healsway will make every effort to deliver the products at the earliest possible time. These delays will not entitle the customer to cancellation or refunds under the standard shipping terms.

         

        4. Consumer Protection and Legal Compliance

        4.1 Compliance with Indian Consumer Protection Laws

        Healsway Systems Solution Pvt. Ltd. adheres to the relevant consumer protection laws and regulations of India, including the Consumer Protection Act, 2019. These terms are designed to safeguard the rights of both the customer and Healsway.

        4.2 Resolution of Disputes

        Any disputes arising from these terms and conditions, or from the customer's use of our services, will be resolved through negotiation, mediation, or arbitration, in accordance with applicable Indian laws. If the dispute remains unresolved, it will be subject to the exclusive jurisdiction of the courts in New Delhi, India, where Healsway is registered.

        4.3 Updates to Terms and Conditions

        Healsway reserves the right to modify or update these shipping terms and conditions at any time without prior notice. The latest version will be made available on our website, and it is the customer's responsibility to review the terms periodically.

        4.4 Governing Law

        These terms and conditions shall be governed by and construed in accordance with the laws of India, specifically the state where Healsway Systems Solution Pvt. Ltd. is registered, without regard to conflict of law principles.

        4.5 Limitation of Liability

        Healsway's liability for any delays or issues related to customized orders, cross-border shipping, customs clearance, or force majeure events shall be limited as outlined in these terms and conditions. By placing an order, customers agree to these terms as part of their purchase agreement.
